Privacy Statement

  1. Caine Real Estate may collect personal information from Clients, Prospective clients, (including prospective purchasers and tenants) Contractors, Suppliers, staff and prospective staff from time to time in pursuit of its primary business as a Real Estate Sales and Property Management Agency.
  2. Caine Real Estate never collects Sensitive Information of any sort at any time. (i.e. Sensitive Information within the meaning of the Privacy Amendment Act 2000)
  3. Caine Real Estate only collects information needed for its business or activities, and, to the extent that it is practical, only from the individual concerned.
  4. When Caine Real Estate collects information, it makes the individual aware, through a verbal or written collection statement, of:
    1. Who is collecting the information
    2. Why the information is being collected
    3. Any consequences of not supplying the information
    4. How the individual may access and correct the information
    5. To whom the information may be disclosed
  5. Wherever possible, Caine Real Estate Marketing and Sales solicitation initiatives are unintrusive, non-personalised, and allow the individual prospect anonymity.
  6. Personal information is used only for the primary purpose for which it was collected or in compliance with various Real Estate State Acts. If Caine Real Estate uses personal information for a secondary purpose, e.g. for marketing additional products or services:
    1. This is with the express or implied consent of the individual, or;
    2. These purposes must be related to the primary purpose for which the information was collected
    3. The individual must reasonably expect such use; and,
    4. The individual must be provided with an express opportunity at any contact to request to "opt-out" at no charge, i.e. to request no further direct marketing communications from the business.
  7. Where an individual request to "opt-out" from further marketing material, Caine Real Estate will maintain a flag on its systems and any future potential contact will be checked and prevented.
  8. Caine Real Estate maintains appropriate security over its electronic and physical records to protect personal information from:
    1. Unauthorised access, use or misuse
    2. Theft
    3. Modification
    4. Disclosure.
      This includes all phases of the information life-cycle from start to finish, and includes the secure destruction of information when it is no longer needed.
  9. Caine Real Estate provides access to their personal information by individuals who request access. The Caine Real Estate Privacy Statement clearly identifies how such access should be requested. An "at cost" fee for access will apply. Where an individual seeks to make corrections to their personal information held by Caine Real Estate, such corrections will be made within 20 working days, provided any such request for correction is reasonably supported or proven by the individual. There is no charge to the individual for making corrections to their record.
  10. Caine Real Estate does not use, adopt or disclose any identifiers issued by a Commonwealth Government Agency.
  11. Where possible, Caine Real Estate provides the option for an individual to interact anonymously.
  12. Caine Real Estate sends no information to foreign countries except where the recipient agrees to protect the information as if it had remained within Australia.
  13. Caine Real Estate has appointed a Privacy Officer to be responsible the Acts guidelines and for implementing and observing procedures to ensure the application of the guidelines to all communications and operations.
  14. Caine Real Estate has developed a set of Privacy Procedures which are provided to staff on appointment. Staff contracts reflect the obligation and responsibility of the staff member with regard to Privacy. All Staff are aware of their privacy obligations, and have been trained to fulfil their respective obligations or comply with the appropriate internal standard procedures.
